In strictly construing the applicable statutes, the court acknowledged that, “Congress said what they said and meant what they said,” Boston attorney Susan G. L. Glovsky noted.
“The court is saying it’s not their job to look at this, and it’s not something that Congress gave them a right to look at. The Patent Office can institute IPR and that’s that,“ Glovsky said.
