Innovation and Patent Eligibility - Theories and Application to Current Cases
When
January 28, 2013
Is my invention eligible for patent protection? Statutory eligibility is among the most important questions in patent law today. Courts have been struggling for decades to provide clear guidelines for innovators of rapidly advancing technology and related business practices.
Join us on Monday, January 28 at the Renaissance Boston Waterfront Hotel, where we will address alternative foundations for patent eligibility and apply them to recent and active cases, including AMP v. Myriad, Mayo v. Prometheus and CLS Bank Int'l v. Alice Corp.
Questions that will be addressed include:
- What is patent eligibility, and how does it compare to patentability?
- What is the role of innovation in assessing patent eligibility?
- Should naturally-occurring materials be eligible for patent protection?
- What about diagnostic methods? Business methods?
- What is the position of the United States Patent and Trademark Office in current cases?
- How should you proceed under the guidelines provided by the United States Patent and Trademark Office?
