The America Invents Act (AIA) provides for new inter partes disputes that are to be conducted by the Patent Trial and Appeal Board (PTAB), including inter partes review (IPR), post-grant review, the transitional post-grant review of covered business method patents, and derivations. A panel experienced in litigation and Patent Office proceedings will provide insight on practicing before the Patent Trial and Appeal Board (PTAB), with a focus on Inter Partes Review, a new trial proceeding conducted at the Board to review the patentability of one or more
claims in a patent only on a ground that could be raised under §§ 102 or 103, and only on the basis of prior art consisting of patents or printed publications.
